Terms
These terms apply when a venue uses Kessl. They sit alongside the order form or plan a venue signs up to, and we have kept them short and plain.
Kessl is provided by 61 West Labs Ltd (“we”, “us”), a company based in the United Kingdom. “You” means the business that signs up to use Kessl. Contact us at hello@61westlabs.co.uk.
Kessl is a point-of-sale service for restaurants, bars and hotels. It includes the iPad app, the web admin, the kitchen display, reporting and the integrations included in your plan. Features vary by plan; your plan sets out what you get, including any limits on venues, devices and staff.
You are responsible for the people you give access to, for keeping sign-in details and PINs private, and for what is done under your account. Tell us promptly if you think an account has been misused. Staff accounts are created and managed by your owner or managers.
Use Kessl only for running your own business, and in line with the law. Do not try to break, overload or reverse-engineer the service, get around limits or security, or use it to process anything unlawful. We may suspend an account that puts the service or other customers at risk, and will tell you why when we do.
Fees are set by your plan and are payable in advance for each billing period unless your order form says otherwise. Fees do not include taxes. We may change prices for a future billing period by giving you at least 30 days’ notice, and you may cancel before the change takes effect.
Your sales, menu, staff and customer records belong to you. You give us permission to process them to provide Kessl. You are responsible for having a lawful basis to record the personal data of your staff and guests, and for telling them how you use it. You can export your data, and on request we will delete it after your account ends, except where the law requires us to keep it. Our privacy notice covers this website.
Kessl records payments taken by cash, by card terminal, to a room account, or by the other methods your plan supports. Kessl does not store full card numbers. Card payments are processed by your payment provider and terminal, under their terms. You are responsible for your agreement with them, for the accuracy of your prices and tax settings, and for the counts and reconciliations your own staff carry out.
Some features rely on services we do not control, such as payment processors, hotel property systems, accounting software, email delivery and Apple’s App Store and TestFlight. We are not responsible for their availability or changes, though we will work with you to keep things running.
We work to keep Kessl available and to fix problems quickly, but we cannot promise it will always be uninterrupted or free from errors. The iPad app is built to keep taking orders and cash payments without an internet connection and to catch up when the connection returns. You should keep your own backup process for anything you cannot afford to lose, such as printed end-of-day reports.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we provide Kessl with reasonable skill and care but give no other promises about fitness for a particular purpose, and we are not liable for lost profit, lost business or indirect loss. Our total liability for anything arising in a 12-month period is limited to the fees you paid us for that period.
You can stop using Kessl and cancel at the end of your billing period. We may end the agreement if you seriously or repeatedly break these terms and do not fix it after we ask. When it ends, your access stops, and we will make your data available for export for a reasonable period before deleting it.
We may update these terms. For changes that matter, we will give you notice before they apply. Continuing to use Kessl afterwards means you accept them.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, unless the law where you operate gives you rights that cannot be waived.
